Maildroppa is a tool to help businesses grow. Our goal is to make email marketing quick and simple, so that users can build and engage their customer base effectively and efficiently. These Terms reflect that goal.
When you set up a Maildroppa account (whether on a free or paid subscription), a legal contract is formed between you and Marcus Biel (“the Owner”, “We”, “Us”). By creating your account, you indicate that you understand and agree to these Terms, and are of legal capacity to enter into a contract.
As a B2B service, Maildroppa only sells to other businesses. You may only use Maildroppa for business purposes.
When you create a Maildroppa account, you must provide information that is accurate, current, and complete. Failure to do so is fraudulent and is grounds for immediate termination of your account, as detailed in the Termination section of this document.
We strive at all times to ensure that your data is kept safe, and to prevent unauthorized access to your account, for purposes including the misuse, theft, manipulation or deletion of your data. To ensure this, you agree to keep your password safe and be responsible for all use of your account. You agree not to share your password with any third party and to notify us immediately if you learn of any breach of security or unauthorized use of your account, so that we can take swift action.
There are various businesses and industries that we do not permit to use either our free or paid service, including any operation linked to illegal activities, as well as gambling services and online casinos. For further details, please read our Acceptable Use Policy.
We’ve designed Maildroppa as a useful tool to help legitimate businesses grow. It is not a tool for spamming people.
With this in mind, Maildroppa includes several features which help you meet anti-spam regulations and requirements. For example, we automatically include your physical address and an opt-out link in the footer of every email, and our subscriber signup forms use double opt-in confirmation.
At the same time, it is up to you to ensure that you do not use the service to send spam. This means that when using Maildroppa, you agree to follow the anti-spam laws of your own country, as well as GDPR (European Regulation) and CAN-SPAM (US law). You can find some useful guidance here:

If Free Plan account holders reach the plan’s subscriber limit, they will be required to provide credit card details and upgrade to a Premium plan before they will be able to add any more subscribers.
If Premium Plan account holders reach their subscription limit, they will be required to upgrade to a higher plan supporting more subscribers before more subscribers can be added.
Alternatively, account holders can remove subscribers from the list until they fall within the limits of their current plan.
It is possible to exceed the subscriber limit for your plan when importing an external subscriber list, so long as the number of subscribers you import is supported by one of Maildroppa’s Premium Plans. If this happens, your account will be paused and you will receive a notification email.
You will need to upgrade to a plan that supports the number of subscribers on your list, or remove enough subscribers to unfreeze the account. Only then will you once more be able to send and receive emails via Maildroppa or add subscribers.
If you have been given a 14-Day Free Trial, you will not be charged if you cancel before the end of the trial period.
If you change plans while on a 14-Day Free Trial, your free trial will continue on your new plan until the trial period has finished (the trial period does not restart when switching plans).
Please note that each business will only have access to the 14-Day Free Trial once, even if you use different emails to register. If we become aware that the same person or organization has used the Free Trial more than once, we will charge said person/organization for any time used additional to the original 14-day trial.
You will be charged for your Maildroppa subscription on the first day of each monthly billing cycle, from the date that your paid subscription starts.
If you change your Premium Plan part way through your billing cycle, your billing cycle will end immediately and a new billing cycle for your new plan will start on the same day. You will receive a prorated credit for the unused portion of your previous plan (“Credit for Unused Plan Time”). The Credit for Unused Plan Time will be subtracted from the new plan price and you will pay the difference.
Any remaining prorated plan credit will be applied to subsequent billing cycles until the credit has been used up. If during any billing cycle your prorated credit only covers a portion of the fee, you will pay the difference.
If you decide to downgrade to Maildroppa’s Free Plan, the change will take place with immediate effect. No refunds will be provided when downgrading from a Premium Plan to a Free Plan.
To continue using your Premium Plan until the end of your current billing cycle, you have two options:
You can cancel your Maildroppa subscription at any time. Cancellation will take effect immediately. Premium Plan users will still be able to use the service until the end of the active billing cycle, but Free Plan users will lose access to the service immediately upon cancellation.
If you cancel your Maildroppa plan, any remaining prorated plan credit will be lost (credit can’t be refunded).
When you cancel your subscription, your account and user data (such as your subscriber list and emails sent using Maildroppa) will be deleted and cannot be restored, so please make sure to export any information you may need before cancelling.
Please note that if you cancel during a free trial period or on the Free Plan, account information deletion will take effect immediately.
Maildroppa and its original content, features and functionality are and will remain the exclusive property of the Owner.
Maildroppa may contain links to third-party websites or services that are not owned or controlled by the Owner.
The Owner has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Owner shall not be held responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
Your use of Maildroppa is solely at your own risk. Maildroppa is provided on an "AS IS" and "AS AVAILABLE" basis. Maildroppa is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and the Owner regarding Maildroppa, and supersede and replace any prior agreements that may have been made between you and the Owner regarding Maildroppa.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use Maildroppa after such revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please cancel your Maildroppa subscription.
We reserve the right to immediately terminate your subscription, without prior notice or liability and without refund, and prevent you from using Maildroppa if you breach any of these Terms or our Acceptable Use Policy.
We also reserve the right to terminate or suspend your access to Maildroppa immediately, with no refund, for other reasons we deem suitable and justifiable, whether or not these reasons are linked to irregularities or misuse of your account. Upon termination, your right to use Maildroppa will immediately cease.
All provisions of the Terms which by their nature should survive termination, shall survive termination.
